The short version: we are a dispatch service that works for you, the carrier. We are not a freight broker or a motor carrier. You approve every load, you stay responsible for operating your truck safely and legally, and you pay a percentage fee only on loads you haul.
1. Acceptance of these terms
By using this website or our services, you agree to these Terms of Service and our Privacy Policy. If you sign a separate dispatch agreement with us, that agreement controls wherever it conflicts with these terms.
2. What we do
Fynex provides truck dispatch and back-office services to independent owner-operators and motor carriers. That includes finding loads, negotiating rates, completing broker setup paperwork, and supporting invoicing and collections. We act as your agent at your direction.
Fynex is not a freight broker, freight forwarder or motor carrier. We do not take possession of freight, issue our own rate confirmations, or hold ourselves out as a carrier. Loads are booked under your operating authority, directly between you and the broker or shipper.
3. Your approval of loads
We present load offers with the rate, miles and details we have. No load is booked without your approval. Once you accept a load, the contract is between you and the broker or shipper, and you are responsible for performing it.
4. Your responsibilities as a carrier
- Hold and maintain active operating authority (MC/USDOT) and all required registrations and permits
- Keep the insurance coverage required by law and by the brokers you haul for, and tell us right away about any change
- Comply with FMCSA regulations, including hours-of-service, drug and alcohol testing and vehicle maintenance
- Give us accurate and complete information about your equipment, documents and availability
- Decide for yourself whether a load is safe and legal for you to haul
5. Fees and payment
Our dispatch fee is 4–8% of the gross line-haul rate for each load you haul that we booked, depending on your equipment type. Your exact rate is negotiated and agreed with you and set out in your dispatch agreement. There is no setup fee and no monthly minimum. The fee is earned when the load is delivered and is invoiced as described in your dispatch agreement. Cancelled loads that you are not paid for are not charged.
6. No guarantee of loads or income
Freight markets change constantly. We work hard to find well-paying freight, but we do not guarantee any number of loads, a particular rate per mile, or any level of income. Examples on this website, such as routes and rates, are for illustration only.
7. Brokers and third parties
We check brokers' credit and payment history before booking, but we do not control, and are not responsible for, the actions, payments or solvency of brokers, shippers, receivers, factoring companies or other third parties. We will help you follow up on late payments, but the debt is owed to you by the broker or shipper.
8. Ending services
There is no long-term contract. Either you or Fynex may stop services at any time by written notice (email is fine). Fees for loads booked before the notice remain payable.
9. Use of this website
You agree not to misuse this website, for example by submitting false information, attempting to break its security, or using it for spam. Website content, including the Fynex name, logo and design, belongs to Fynex Group and may not be copied without permission.
10. Disclaimers
This website and its content are provided "as is". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the fullest extent allowed by law, Fynex will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, cargo loss or damage, accidents, fines or penalties. Our total liability for any claim relating to our services is limited to the dispatch fees you paid us for the load the claim relates to.
12. Indemnity
You agree to indemnify and hold Fynex harmless from claims, losses and costs arising from your operation of your trucking business, including the transport of freight, your drivers and equipment, and your compliance with laws and regulations.
13. Governing law
These terms are governed by the laws of the State of [STATE] and applicable federal law of the United States, without regard to conflict-of-law rules.
14. Changes
We may update these terms from time to time. The "Effective" date at the top shows when they last changed. Continuing to use our website or services after a change means you accept the updated terms.
